Travel insurance
Unless expressly stated otherwise by the present Special Terms and Conditions, the General Terms and Conditions TUp Solutions Entreprises CG – W.03.2013 are applicable
1. Bus Ticket Cancellation Coverage
1.1. Purpose and amount covered
The Insurance Company guarantees insured parties reimbursement of:
cancellation fees that are contractually due when the reserved bus trip is cancelled. The declaration of cancellation has to be made no later than 48 hours after the departure time of the bus
The aforementioned refunds are limited to the price of the bus ticket(s).
In case of illness or accidents the above mentioned refunds are only granted if these illnesses or accidents occurred after the reservation date of the bus ticket.
1.2. Entry into force and duration of cover
This insurance cover takes effect from the date the policy is subscribed and ceases automatically when the bus ticket is cancelled, at the latest at the date and time of departure of the insured bus trip.
This cover must be taken out at the latest when booking the bus ticket to which it refers.
1.3. Cases covered by the insurance
1.3.1. In case of death or accident requiring more than 48 hours of hospitalisation of the Insured, a family member or the travel companion, a person residing at the same address as the beneficiary for whom he/she is legally responsible.
1.3.2. In case of illness of the Insured, his/her spouse, the person accompanying the Insured during the bus trip, a person residing at the same address as the beneficiary for whom he/she is legally responsible, certified medically as rendering such persons incapable of continuing the trip of the Insured.
1.3.3. In case of illness of the direct family members of the Insured, certified medically and requiring the presence of the Insured at their bedside.
1.3.4. In case of death or accident requiring more than 48 hours of hospitalisation, of the professional locum or a person responsible for looking after the beneficiary’s under-age or handicapped child, provided such persons were designated by name when the bus trip was booked.
1.3.5. In case of complications occurring during the pregnancy of the Insured, her spouse (legal or de facto), a parent or 1st-degree relative of the Insured, a person accompanying the Insured during the bus trip
1.3.6. Pregnancy of the Insured or the travelling companion, provided that the trip by plane was planned during the last 3 months of pregnancy and that the pregnancy was not known when the bus trip was booked.
1.3.7. In case of serious problems (imperatively requiring the presence of the Insured on the day of departure), which had not occurred when the bus trip was booked and which were due to a fire, water damage or a storm damaging the latter’s property.
1.3.8. In case the Insured is called upon for humanitarian aid or for a military mission, provided that the latter did not know about it when booking the bus trip.
1.3.9. In case the Insured called upon
- as a witness in court or for jury service,
- for reasons relating to the adoption of a child,
- for reasons relating to an organ transplant.
1.3.10. In case of theft of identity documents or a visa, refusal by the authorities of the destination country to issue a visa, provided that the Policyholder was warned within 48 hours of that refusal.
1.3.11. In case the Insured is required to be present at a new employment.
1.3.12. In case of cancellation of the employment contract (except for cancellation due to serious misconduct) notified by the employer to the Insured or to one of the members of his family living under the same roof, insured by this contract and mentioned on the same bus travel document / confirmation, on condition that this situation was not known when the policy was taken out.
1.4. Obligations in case of claims
1. Immediately inform the policyholder of the cancellation of the bus trip as soon as an occurrence that could prevent departure is known.
2. Inform the Insurance Company in writing within 5 days following announcement of the cancellation. The Insured must complete the “Declaration of Cancellation” form and send it with a medical report and without delay to the Insurance Company accompanied by documentary proof.
3. Send immediately all useful information to the Insurance Company and in any case within 30 days. Answer any questions asked in order to determine the circumstances and the extent of the claim.
4. Take any measures necessary to prevent and limit the consequences of the claim.
5. If the Insurance Company considers it necessary, the Insured Party who instigates the cancellation must furthermore submit to a medical examination conducted by a doctor appointed by the Insurance Company.
1.4. Compensation
The refund of the cancellation fees is based on the chosen insurance product at the price of the bus ticket(s).
2. Luggage Insurance and miscellaneous coverages
2.1. Scope of the coverage
2.1.1. The purpose of this insurance is to cover the Insured Party up to the amount insured against the destruction, theft or loss of all or some of his luggage, as well as against any damage caused thereto due to any fortuitous circumstance occurring during the insured bus trip.
The insurance comes into effect at the moment when the Insured enters the means of transport organised by the policyholder or hands over his baggage to the policyholder and it ends when the Insured has reached the destination, but at the latest when the Insured definitely leaves the means of transport organised by the policyholder or takes his baggage permanently.
The luggage is insured, including the items carried and the camping equipment that the Insured carries for personal use, up to the amount stipulated per person in the Specific Terms and Conditions.
2.1.2. For luggage entrusted to others:
- In case of loss, total or partial damage to luggage entrusted to the policyholder;
- in case of destruction, theft or loss during the insured bus trip, for the purchase of essentials up to 25 % of the basic insured capital, without extras (please join the original purchase bills to the luggage claim declaration).
Photographic devices, cameras and portable computers, as well as their accessories, are only insured in the registered luggage if they were in a closed and locked suitcase.
2.1.3. For luggage under the supervision of the Insured – in case of loss, total or partial damage resulting from
- criminal acts (theft for example),
- accidents in which the insured person suffers a severe injury or a transport accident (a road accident, for example),
- a fire or events resulting from the behaviour of the elements (floods, for example).
2.2. Cover limits
2.2.1. The capital insured is set at the value determined in the travel solution chosen by the policyholder.
2.3. Compensation modalities
The exclusions of the General Terms and Conditions are applicable.
The following are also excluded from the insurance cover:
2.3.1. Compensation will be made without applying the proportionality rule.
The Company reserves the right to repair or replace all or some of the damaged or vanished objects. No replacement or repair can be made at the expense of the Company without prior agreement.
If lost or stolen items are recovered after the Company has paid compensation, the Insured may either hand over the recovered item to the Company in respect of the compensation or recover the item and reimburse the compensation. The Company is only obliged to pay the taxes to the extent that they are actually the Insured’s responsibility.
2.3.2. Sports items, such as skis and surfboards, and camping equipment are covered by the insurance.
If the objects covered by the policy consist of pairs or groups of objects, such as cufflinks, earrings, skis, etc. insured for their total value, the value of each object will be calculated by dividing the total value by the number of objects comprising the pair or group.
In the case of loss, destruction, theft or damage, the Company will settle the claim using that value as the basis and without taking into account the depreciation that might occur because the pair or group is no longer complete.
2.4. Exclusions
The exclusions of the General Terms and Conditions are applicable.
The following are also excluded from the insurance cover:
2.4.1. damage caused by depreciation, slow or natural deterioration, damages caused by atmospheric influences, the nature of the items, wear and tear and damage resulting from humidity, a defect in the insured object itself or from any kind of cleaning, repair or restoration process;
2.4.2. damage caused to watches, clocks or other devices resulting from the efforts of the Insured to forcibly winding them up;
2.4.3. any kind of mechanical damage not resulting from an obvious accident, scratches and bumps;
2.4.4. cash, banknotes, shares, travel tickets, stamp collections and securities of any kind, handwritten documents or merchandise;
2.4.5. jewellery is not covered if it is was put in the entrusted luggage;
2.4.6. the breakage of fragile objects such as clocks, porcelain, glass, musical instruments, unless this is the result of a fire, theft or an accident in the transport used;
2.4.7. the breakage or loss of spectacles, contact lenses, medical devices or prostheses in general;
2.4.8. objects forgotten, mislaid, lost in non-fortuitous circumstances;
2.4.9. fine pearls and precious stones that fell out of their mounting in non-fortuitous circumstances;
2.4.10. objects left unattended by the Insureds in a public place;
2.4.11. the consequences of a theft occurring in an unlocked vehicle when the objects are not guarded by the Insured or were not entrusted to the Policyholder.
3. Missed flight coverage
3.1. Purpose and amount covered
Purpose of this insurance is to cover the Insured in case of a missed flight due to insured fortuitous circumstances (article 3.3.):
- occurred during the reserved bus trip and entailing an arrival at the terminal of the destination airport after the registration period fixed by the airline with which the Insured has reserved and paid a flight ticket;
- occurred before the departure of the bus trip reserved and paid by the Insured and entailing an arrival at the terminal of the airport of destination after the period of registration fixed by the airline with which the Insured has reserved and paid a flight ticket
The Company guarantees the reimbursement to the insured parties:
- of the price of the flight ticket or the fees of a later replacement flight ticket in case of a missed flight (maximum amount of 250,00 € per insured person).
When the Insured is able to take the reserved flight but the airline claims a possible service charge for late presentation at the check in counter (arrival of the Insured at the airport counter after the fixed registration time), the Company reimburses the claimed service fee (with a maximum amount of € 250.00 per insured person).
3.2. Entry into force of the cover
This cover must be taken out at the latest when booking the bus ticket to which it refers.
3.3 Cases covered by the insurance
3.3.1. The guarantee applies only to bus travel booked by the Insured whose time of arrival at the terminal of the destination airport provided by the carrier is at least 40 minutes before check-in closes.
3.3.2. Fortuitous circumstances during the bus trip reserved by the Insured
Excluding all other circumstances, the following are considered as insured fortuitous circumstances:
- traffic congestion between the place of departure of the bus and the destination airport terminal;
- roadblocks or road diversions not known at the time of departure and preventing the carrier from taking the usual roads;
- bus breakdowns or discomforts suffered by the driver during the journey;
- traffic accidents involving the bus making the insured trip;
- delays due to vehicle checks carried out by public authorities during the trip;
- weather (snow, ice, heavy rain, thunderstorms, storms, hail).
3.3.3. Fortuitous circumstances before departure of the bus trip reserved by the Insured
To the exclusion of all other circumstances, the following are considered insured fortuitous circumstances:
- cancellation of the bus trip by the carrier prior to the bus departure;
- the bus not coming to the designated bus stop;
- delayed departure of the bus to the destination airport.
